These terms cover your use of TrenchIQ. Creating an account means you accept them.
TrenchIQ (“Trench”, “we”) provides bid estimation and job tracking software for construction contractors. These terms are between Trench and the company whose account you create or join (“you”). If you are accepting on behalf of a company, you confirm you are allowed to.
You are responsible for what happens under your login and for keeping your password to yourself. Tell us promptly if you think someone else has it. You may invite people from your company; you are responsible for what they do in your account.
You must be at least 18 and able to enter into a contract.
Anything to do with running your construction business. What you may not do: resell or rent access, attempt to break into another company’s data, probe or overload the service, copy it to build a competing product, or use it to break the law.
Your bids, unit prices, cost build-ups, catalog, crew rates, job records and documents belong to you. We do not sell them, and we do not pool them with other contractors’ numbers or publish them in any form — aggregated, anonymized or otherwise.
You give us only the permission we need to run the service for you: storing your data, backing it up, showing it to the people you invite, and sending it to the services listed in the Privacy Policy that make the product work. Nothing more.
Trench was built by people who run a construction company, and you are trusting us with the numbers you win work on. So, plainly: neither Trench nor anyone who works on it will use your bids, prices or cost data to prepare a bid, to price work, to advise another contractor, or to compete with you in any way.
Being part of the Trench team does not open your pricing. The database itself keeps every company’s bids behind its own wall, and that includes the contractor Trench was built with. How that works, and the narrow case in which one person at Trench can look at your data, is in section 3 of the Privacy Policy.
Trench calculates a bid from the numbers you enter. It cannot know whether a quantity, a unit cost or a rate is right, and a wrong number in produces a wrong bid out. Software can also have bugs, including bugs that affect a total, a unit price, a rounding or a document.
You are responsible for reviewing every bid, price and document before you submit or rely on it, and for the bid you submit. Trench is a tool that helps you prepare a bid; it does not give estimating, engineering, legal or financial advice, and it does not decide what you bid.
That means we are not responsible for the outcome of a bid — one that is too low and wins a job at a loss, one that is too high and loses, one that is rejected, or one submitted late — whether the cause is a number you entered, a default you didn’t change, a document you didn’t check, or a fault in Trench. If you find a number that looks wrong, tell us straight away and we will treat it as our most urgent kind of problem.
Some features read documents you upload — a supplier quote, a photographed receipt or scale ticket — and propose values from them. Those are proposals. Nothing they suggest reaches a bid until you confirm it, and you should check it.
Trench is in beta. Features are new, some are unfinished, and things will change as we learn from you. Some features may be labeled as early or experimental, and we may switch them on or off for your account.
If you are part of our beta program, a separate Beta Program Agreement covers what you commit to and what you receive, including any free access. If it and these terms disagree, these terms win unless the agreement says otherwise in so many words. Feedback you give us is ours to use to improve Trench, with nothing owed for it; your data stays yours under section 4.
Trench is not currently charging for accounts. If we introduce a price, we will tell you the amount and the date before it applies to you, and you can close your account instead.
We work to keep Trench up and your data safe, but we do not promise the service will be uninterrupted or error-free, or available at the moment a bid is due. Keep your own copy of anything you can’t afford to lose access to on deadline day — the bid PDF and CSV exist for exactly that. We may change or remove features; if a change would lose data you rely on, we will tell you first.
The service is provided as-is and as-available, without warranties of any kind — including that it is fit for a particular purpose or that its results are accurate — beyond those the law requires us to give.
To the extent the law allows, Trench is not liable for lost profits, a lost job, a bid that was not awarded, a job won at a price that turned out too low, bid bond or surety claims, or any indirect, incidental or consequential loss, even if we were told it could happen. Our total liability to you for any claim is limited to what you paid us in the twelve months before it arose, or $100 if you have paid us nothing.
If someone else — an owner, a general contractor, a surety, a supplier or one of your employees — brings a claim against Trench over a bid you submitted, work you performed, or the way you used Trench, you agree to cover our reasonable costs of defending it and any amount we have to pay, unless the claim is caused by our own breach of section 4 or 5.
You can stop using Trench and close your account at any time. Ask us and we will give you a copy of your data in a readable format, then delete it.
We may suspend or close an account that breaks section 3, and will say why. If we close your account for any other reason, we will give you reasonable notice and the chance to take your data with you.
If we change these terms in a way that matters, we will post the new version with a new effective date and tell account owners by email before it takes effect. Continuing to use Trench after that date means you accept the new version.
These terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. Any dispute goes to the state or federal courts located in Utah.
